Algemene voorwaarden

Welkom bij The Colorful Collective! 
 

Artikel 1 Algemeen

1.1. Deze algemene voorwaarden zijn van toepassing op de totstandkoming en uitvoering van alle overeenkomsten die tussen The Colorful Collective en deelnemers worden gesloten.

1.2. In deze algemene voorden wordt verstaan onder

1. The Colorful Collective: The Colorful Collective, gevestigd te Breda 
2. Deelnemer: natuurlijk persoon die niet handelt in de uitoefening van beroep of bedrijf en die een overeenkomst aangaat met betrekking tot activiteiten en/of afname diensten en/of producten.
3. Docent: diegene die de activiteit begeleidt. 
4. Activiteiten: les, afspraak, workshop of lezing aangeboden door één van de docenten van The Colorful Collective 
5. Producten: alle producten die via de webshop aangeboden worden. 
6. Overeenkomst: de overeenkomst, gebaseerd op deze algemene voorwaarden, waarin de deelnemer en de organisatie schriftelijk overeenkomen dat de organisatie activiteiten die de deelnemer met de instructeur heeft afgesproken, zal verzorgen. 
7. YogiBit: het onlinesysteem inclusief de YogiBit app waarmee The Colorful Collective activiteiten, afspraken, deelnemersaantallen, locaties en tijdstippen plant en producten verkoopt. De YogiBit app is vindbaar in de App store en Play store en de webversie is vindbaar op https://thecolorfulcollective.yogibit.nl/web/

Artikel 2 Toepasselijk recht 

2.1. Zodra u een proefles afneemt, geregistreerd bent en/of een product of dienst afneemt via YogiBit, wordt u deelnemer van The Colorful Collective. Deze voorwaarden zijn van toepassing op ieder deelnemer en op alle activiteiten en producten die The Colorful Collective aanbiedt. 

2.2. Van deze Algemene Voorwaarden kan alleen worden afgeweken indien dat schriftelijk is bevestigd door The Colorful Collective. 

2.3. Op deze overeenkomst is Nederlands Recht van toepassing. 

2.4. Geschillen die voortkomen uit deze overeenkomst, en die niet in goed onderling overleg kunnen worden opgelost, zullen worden onderworpen aan de bevoegde rechter in de regio. 

Artikel 3 Aansprakelijkheid en deelname activiteiten
3.1. Deelname aan een Activiteit geschiedt geheel op eigen risico. The Colorful Collective, haar medewerkers en docenten, zijn niet aansprakelijk voor persoonlijk letsel of schade aan eigendommen van een deelnemer die deelneemt aan een activiteit. Ook voor mogelijke schade die ontstaat door andere diensten of adviezen van haar medewerkers en docenten, is The Colorful Collective niet aansprakelijk. 

3.2. Deelnemer dient zelf in te schatten of ze geschikt is voor deelname aan de activiteit. Deelnemer dient de docent van te voren op de hoogte te stellen van eventuele lichamelijke en/of psychische klachten zoals blessures, fysieke beperkingen, gezondheidsproblemen of zwangerschap. Bij enige twijfel over deelname activiteit ten gevolgen van gezondheidsklachten wordt geadviseerd eerst met docent te overleggen en indien nodig een arts te raadplegen.

3.3. Deelnemer verklaart hierbij geheel op eigen risico en op eigen verantwoording deel te nemen aan de activiteiten van The Colorful Collective. Deelnemer dient gedurende het volgen van de lessen of activiteiten veranderingen in lichamelijke conditie te melden.

3.4. Adviezen zijn altijd vrijblijvend en worden op eigen risico opgevolgd.

3.5. De docent van The Colorful Collective behouden zich het recht voor om naar zijn of haar beoordeling ongeschikte deelnemers uit te sluiten van deelname aan groepsactiviteiten voor het behoud van de veiligheid van de deelnemer.

3.6. The Colorful Collective is niet verzekerd voor schade van deelnemer. Deelnemer, contractspartner of wederpartij verklaart dat zij is verzekerd voor schade geleden ten gevolge van de deelname aan een activiteit. 

3.7. The Colorful Collective is niet aansprakelijk voor schade aan en/of vermissing van persoonlijke eigendommen door welke oorzaak ook, ontstaan tijdens of in verband met een activiteit. 

3.8. Deelnemer doet hierbij dan ook onvoorwaardelijk en onherroepelijk afstand van haar recht op schadevergoeding voor enige directe of indirecte schade (hetzij uit overeenkomst of onrechtmatig handelen) die is in verband met deelname aan een activiteit is ontstaan, ontstaat of zal ontstaan.

3.9. The Colorful Collective behoudt zich het recht voor een activiteit bij onvoldoende belangstelling/bezetting te annuleren. Bij gevaarlijke weersomstandigheden, waaronder onweer, storm, extreme warmte, sneeuw of ijzel, kan een activiteit worden afgelast.

Artikel 4 Lidmaatschap 

4.1. Deelnemer is bekend met het feit dat zijn/haar lidmaatschap aangegaan wordt voor de afgesproken contractduur die ingaat vanaf de in YogiBit vermelde ‘Startdatum abonnement’ of ‘Aanschafdatum rittenkaart’. 

4.2. Het lidmaatschap is strikt persoonlijk en kan alleen na toestemming van The Colorful Collective worden overgedragen aan een derde, waarbij The Colorful Collective het recht heeft administratiekosten in rekening te brengen.

4.3. The Colorful Collective behoudt zich het recht voor nieuwe leden bij inschrijving om identificatie te vragen. 

4.4 Leden kunnen zich tot maximaal 2 uur voor aanvang van een activiteit in- of uitschrijven, de vastgestelde tijd voor de desbetreffende activiteit is te vinden in de YogiBit app. Bij niet of niet op tijd annuleren wordt de activiteit in rekening gebracht of afgeschreven van de rittenkaart. 

Artikel 5 Inschrijven en deelname lessen

5.1. Deelnemer dient zich in te schrijven in YogiBit. Leden kunnen zich aanmelden tot maximaal 6 uur voordat de training aanvangt. Uitgezonderde lessen hierbij zijn:

- Glow en Grow Fitness op de maandagochtend, inschrijven is hier uiterlijk12 uur van te voren;

- Postnatal Yoga (EN) op woensdagavond hierbij is de inschrijving uiterlijk 24 uur van te voren

- Prenatal Yoga (EN) op vrijdagochtend, hierbij is de inschrijving uiterlijk 24 uur van te voren.

5.2. Bij verhindering dient deelnemer zich minimaal 2 uur voor aanvangstijdstip van de geplande activiteit af te melden in Yogibit. Bij niet of niet op tijd annuleren wordt een credit in rekening gebracht.

Artikel 6 Flexwerken

6.1. Deelnemer dient zich in te schrijven in Yogibit voor het gewenste tijdsblok. Maximaal aantal deelnemers per flexblok is 4. 

Artikel 7 Wijzigingen en tussentijdse wijzigingen 
7.1. The Colorful Collective is gerechtigd de op het lidmaatschap van toepassing zijnde voorwaarden te wijzigen. The Colorful Collective zal deelnemer hiervan tijdig op de hoogte brengen. De wijzigingen treden één kalendermaand na de bekendmaking in werking, tenzij een afwijkende wettelijke termijn is vereist, die alsdan wordt toegepast. Indien een deelnemer een voor hem nadelige wijziging niet wenst te accepteren, kan hij zijn lidmaatschap beëindigen met ingang van de datum waarop de nieuwe voorwaarden van kracht worden. De schriftelijke opzegging dient voor de ingangsdatum van de wijziging door The Colorful Collective te zijn ontvangen.

7.2. The Colorful Collective kan tussentijdse wijzigingen aanbrengen in de aangeboden faciliteiten, lesroosters, programma’s en openingstijden. The Colorful Collective heeft het recht het groepslesrooster te allen tijde te wijzigen om haar motiverende redenen. De betalingsverplichting blijft in deze gevallen onverminderd van kracht.

7.3. The Colorful Collective zal de voorgenomen wijzigingen minimaal twee (2) weken van tevoren op genoegzame wijze aankondigen, tenzij dergelijke wijzigingen redelijkerwijs niet zo lang van tevoren kunnen worden aangekondigd. 

7.4. Bij wijzigingen ten nadele van deelnemer heeft de deelnemer gedurende 4 weken na de aankondiging het recht om het lidmaatschap met een opzegtermijn van één maand te beëindigen, tenzij de wijziging een beëindiging niet rechtvaardigt. 

Artikel 8 Overmacht, ziekte, vakanties en feestdagen 

8.1 The Colorful Collective is niet gehouden tot nakoming van enige verplichting uit de overeenkomst indien The Colorful Collective daartoe verhinderd is als gevolg van een omstandigheid die aan The Colorful Collective niet op grond van de wet, rechtshandeling of in het maatschappelijk verkeer aanvaarde beginselen is toe te rekenen. 

8.2 Onder overmacht wordt in deze algemene voorwaarden naast hetgeen in de wet en jurisprudentie wordt verstaan, mede begrepen: (burger)oorlog en dreiging van (burger)oorlog, natuurrampen, stakingen, bovenmatig ziekteverzuim of ziekte van het personeel of door The Colorful Collective ingeschakelde derden, epidemieën, pandemieën, brand, overstroming, stroomstoringen, overheidsmaatregelen, wanprestatie van toeleveranciers of ingeschakelde derden, wanprestatie of overmacht van toeleveranciers zoals waardoor The Colorful Collective niet (meer) aan haar verplichtingen jegens de deelnemers kan voldoen alsmede alle van buiten komende al dan niet voorzienbare oorzaken die buiten de macht van The Colorful Collective liggen maar waardoor The Colorful Collective niet in staat is haar verplichtingen uit de Overeenkomst na te komen. 

8.3 In geval van overmacht spant The Colorful Collective zich in om de overeenkomst op een andere manier na te komen. De deelnemer zal hiertoe alle instructies van The Colorful Collective opvolgen. 

8.4 Gedurende de periode dat de overmacht voortduurt, kan The Colorful Collective en deelnemer de verplichtingen uit de overeenkomst opschorten, indien de periode langer duurt dan twee (2) maanden is zowel The Colorful Collective als de deelnemer gerechtigd de overeenkomst op te zeggen met inachtneming van de in lid 7 van artikel 3 genoemde opzegtermijn. 

8.5 Bij ziekte en/of vakantie van (één van) de docenten kan het geldende rooster met activiteiten aangepast worden. Het kan voorkomen dat events worden afgelast of samengevoegd. Dit is in het geldende tarief verwerkt en er kan geen aanspraak op restitutie o.i.d. gemaakt worden. Te allen tijde zal geprobeerd worden om een vervangende docent te regelen, echter indien dit niet mogelijk is zal de activiteit vervallen.

8.6 Op onderstaande algemene erkende feestdagen gaan de activiteiten niet door, tenzij anders gecommuniceerd. De betalingsverplichting blijft in deze gevallen onverminderd van kracht daar dit in het geldende tarief verwerkt is.

• Goede vrijdag

• 1ste en 2de paasdag

• Koningsdag

• Hemelvaartsdag

• Bevrijdingsdag (lustrumjaren)

• 1ste en 2de pinksterdag

• 1ste en 2de kerstdag

• Oudejaarsdag 

Artikel 9 Bedenktijd 

9.1 Deelnemer, die een natuurlijk persoon is en niet handelt in de uitoefening van beroep of bedrijf, heeft het recht de Overeenkomst kosteloos te ontbinden gedurende een bedenktijd van veertien (14) kalenderdagen. Deze bedenktijd gaat in op de dag volgende op die van de totstandkoming van de Overeenkomst. 

9.2 Indien deelnemer tijdens deze bedenktijd op eigen verzoek gebruik maakt van de diensten van The Colorful Collective en vervolgens een beroep doet op zijn herroepingsrecht, is deelnemer aan The Colorful Collective een evenredige vergoeding verschuldigd over de periode dat hij gebruik heeft gemaakt van de diensten. 

9.3 Deelnemer kan The Colorful Collective op de hoogte stellen van het gebruik van zijn herroepingsrecht door een schriftelijk verzoek in te dienen. 

Artikel 10 Duur en beëindiging

10.1 The Colorful Collective is gerechtigd de overeenkomst per direct geheel of gedeeltelijk op te zeggen zonder verplichting tot schadevergoeding als deelnemer niet, of slechts gedeeltelijk aan zijn verplichtingen uit de overeenkomst voldoet. 

10.2 Opzegging van het lidmaatschap door deelnemer dient schriftelijk via de site van The Colorful Collective te geschieden. Hiervoor geldt een opzegtermijn van een kalendermaand waarbij de maand van opzegging niet wordt meegerekend. De overeenkomst heeft een minimale looptijd van zes maanden. 

Artikel 11 Tarieven, tariefswijzigingen en betaling 

11.1. Het verschuldigde lidmaatschapsbedrag zal The Colorful Collective iedere maand automatisch incasseren. Het machtigingsformulier zal deelnemer tijdig aan The Colorful Collective doen toekomen of kan digitaal in de app worden ondertekend. Indien om wat voor reden dan ook er geen mogelijkheid is tot automatische incasso, is The Colorful Collective gerechtigd deelnemer de toegang tot de activiteit te weigeren totdat deelnemer aan zijn financiële verplichtingen heeft voldaan. In dat geval wordt de duur van de overeenkomst niet met de duur van de opschorting verlengd. 

11.2.Het abonnementsgeld wordt voorafgaand aan het sluiten van de overeenkomst overeengekomen. 

11.3. The Colorful Collective heeft het recht deze prijzen eenzijdig te verhogen. De actuele prijzen zijn altijd de geldende prijzen en deze zijn steeds beschikbaar op de website van The Colorful Collective of in de app van YogiBit. 

11.4. In het geval van een prijsverhoging, heeft deelnemer het recht om de overeenkomst binnen 4 weken, na de bekendmaking van de verhoging door The Colorful Collective, te ontbinden. 

11.5. Een lidmaatschap wordt – met uitzondering van de eerste maand die direct bij het afsluiten ervan wordt betaald – maandelijks van de bankrekening van een deelnemer afgeschreven. 

11.6. Een overeenkomst anders dan een lidmaatschap dient vooraf ineens te worden betaald. 

11.7. Tenzij anders overeengekomen dienen betalingen te geschieden via automatisch incasso of via de webshop van The Colorful Collective. 

11.8. Indien het verschuldigde bedrag niet van de bankrekening kan worden afgeschreven, wordt een herinnering gestuurd. Indien hier niet op gereageerd wordt en er geen betaling volgt wordt er EUR 25,- administratiekosten in rekening gebracht, welke tegelijkertijd met de eerstvolgende maandbetaling zal worden afgeschreven. 

11.9. Met inachtneming van de toepasselijke wetgeving is deelnemer alle kosten, die The Colorful Collective of een door The Colorful Collective ingeschakelde derde partij heeft gemaakt ter incassering van enig bedrag dat deelnemer aan The Colorful Collective verschuldigd is, aan The Colorful Collective verschuldigd. 

11.10. The Colorful Collective heeft het recht om uitvoering van haar verplichtingen op te schorten indien deelnemer niet tijdig aan zijn verplichtingen heeft voldaan. 

Artikel 12 Opschorting (pauzeren/tijdelijk stopzetten) 

12.1. Alleen in geval van een langdurige ziekte, blessure, of zwangerschap kan met schriftelijke toestemming van The Colorful Collective het lidmaatschap tijdelijk worden opgeschort (dit geldt niet bij bijv. studie, stage, werk en vakantie). Op eerste verzoek van The Colorful Collective overlegt deelnemer schriftelijke bewijsstukken. 

12.2. Voor eventuele pauzeringen dient deelnemer te allen tijde een schriftelijk verzoek met volledige uitleg van reden tot pauzering van lidmaatschap in te dienen. 

12.3. Een schriftelijk verzoek dient te allen tijde minimaal 14 dagen voorafgaand aan de te pauzeren maand ingediend te worden. 

12.4. Opschorting van lidmaatschap kan nooit met terugwerkende kracht. 

12.5. De betalingsverplichting van deelnemer wordt opgeschort voor de daadwerkelijke duur van de opschorting. De einddatum van de lidmaatschapsovereenkomst wordt verlengd met de duur van de daadwerkelijke opschorting. De eerste termijn wordt mogelijk nog geïncasseerd en het bedrag zal dan bij her-activatie van het lidmaatschap worden verrekend. Het is in geen geval een wijze om de betalingsverplichting uit te stellen. 

12.6. The Colorful Collective behoudt te allen tijde het recht om een verzoek af te wijzen zonder opgaaf van reden. 

Artikel 13 Verplichtingen deelnemer 

13.1. Deelnemer is bekend met de door The Colorful Collective gehanteerde huisregels. Deze huisregels zijn aanwezig in alle ruimtes. Deelnemer is verplicht deze huisregels na te leven. 

13.2. The Colorful Collective kan te allen tijde de toegang weigeren of ontzeggen aan personen wiens gedrag daar aanleiding toe geeft. 

13.3. Deelnemer dient een medische contra-indicatie, indien van toepassing, voor aanvang activiteit te melden aan The Colorful Collective. 

13.4. Deelnemer dient de aanwijzingen van The Colorful Collective c.q. de door hem aangestelde medewerkers op te volgen. 

13.5. Deelnemer dient wijzigingen in het postadres, e-mailadres, bankrekening- nummer en telefoonnummer tijdig schriftelijk of elektronisch aan The Colorful Collective mede te delen. 

Artikel 14 Tussentijdse wijzigingen 

14.1. The Colorful Collective kan tussentijdse wijzigingen aanbrengen in de aangeboden faciliteiten, lesroosters, programma’s en openingstijden. 

14.2. The Colorful Collective zal de voorgenomen wijzigingen minimaal twee (2) weken van tevoren op genoegzame wijze aankondigen, tenzij dergelijke wijzigingen redelijkerwijs niet zo lang van tevoren kunnen worden aangekondigd. 

14.3. Bij wijzigingen, zoals bedoeld in artikel 3, ten nadele van deelnemer heeft de deelnemer gedurende 4 weken na de aankondiging het recht om het lidmaatschap met een opzegtermijn van één maand te beëindigen, tenzij de wijziging een beëindiging niet rechtvaardigt. 

Artikel 15 Persoonsgegevens

15.1. The Colorful Collective verwerkt de persoonsgegevens van deelnemer binnen de kaders van de toepasselijke wet- en regelgeving inzake de bescherming van de persoonlijke levenssfeer, in het bijzonder de Wet en bescherming persoonsgegevens, op een wijze en voor de doeleinden zoals hieronder nader omschreven.

15.2 The Colorful Collective verwerkt persoonsgegevens voor de doeleinden: facturatie, debiteuren administratie, klachtenafhandeling en geschillenbeslechting ter voorkoming, opsporing en bestrijding van fraude en onregelmatigheden, voor marktonderzoek en commerciële doeleinden zoals verkoopactiviteiten met betrekking tot de diensten van The Colorful Collective en/of diensten van derden die te maken hebben met de diensten van The Colorful Collective.

15.3. Deelnemer heeft inzage-, correctie- en verzetrecht met betrekking tot de van hem verwerkte persoonsgegevens. The Colorful Collective kan voor een inzage en/of doorvoeren van correcties en/of voor het behandelen van een verzet kosten in rekening brengen tot het wettelijk maximum. De betreffende deelnemer kan bezwaar tegen verwerking van zijn persoonsgegevens en verzoeken tot inzage, correctie en verzet zenden aan The Colorful Collective. 

15.4. Deelnemer geeft toestemming voor het maken en publiceren van beeldmateriaal bij The Colorful Collective waarop hij/zij herkenbaar is. Wil deelnemer dit niet, dan kan hij/zij dit aangeven bij de directie van The Colorful Collective. The Colorful Collective zal die honoreren. 

15.5. YogiBit wordt aangeboden door de online dienst SportBit Manager. Privacyverklaring  met betrekking tot gebruik van YogiBit is te lezen op https://www.sportbitmanager.nl/privacy/ 

Artikel 16 Klachten en geschillen 

16.1. Deelnemer dient een klacht met betrekking tot enige prestatie van The Colorful Collective zo spoedig mogelijk nadat het gebrek of de schade is geconstateerd bij The Colorful Collective te melden, en uiterlijk binnen veertien (14) dagen nadat deelnemer de gebreken of schade heeft geconstateerd. De klacht dient schriftelijk ingediend te worden bij The Colorful Collective onder vermelding van de omschrijving van de klacht. 

16.2. De klacht dient volledig, duidelijk omschreven en voorzien zijn van eventuele bewijsmiddelen. 

16.3. The Colorful Collective beantwoordt de door deelnemer ingediende klacht zo spoedig mogelijk, maar uiterlijk binnen vier (4) weken vanaf de datum van ontvangst. Indien The Colorful Collective verwacht langer tijd nodig te hebben voor de verwerking van de klacht vermeldt zij dit direct per e-mail aan deelnemer na de constatering hiervan. 

16.4. Indien klacht niet in onderling overleg kan worden opgelost ontstaat er een geschil overeenkomstig artikel 2.4. van deze Algemene Voorwaarden.

Welcome to The Colorful Collective!

Article 1 General
1.1. These general terms and conditions apply to the formation and execution of all agreements entered into between The Colorful Collective and participants.

1.2. In these general terms, the following definitions apply:

1. The Colorful Collective: The Colorful Collective, located in Breda
2. Participant: a natural person who is not acting in the exercise of a profession or business and who enters into an agreement regarding activities and/or purchases services and/or products.
3. Instructor: the person who guides the activity.
4. Activities: classes, appointments, workshops, or lectures offered by one of the instructors of The Colorful Collective.
5. Products: all products offered through the webshop.
6. Agreement: the agreement, based on these terms and conditions, in which the participant and the organization agree in writing that the organization will provide the activities agreed upon between the participant and the instructor.
7. YogiBit: the online system, including the YogiBit app, through which The Colorful Collective schedules activities, appointments, participant numbers, locations, and times and sells products. The YogiBit app can be found in the App Store and Play Store, and the web version is available at https://thecolorfulcollective.yogibit.nl/web/.

Article 2 Applicable Law
2.1. Once you take a trial class, are registered, and/or purchase a product or service via YogiBit, you become a participant of The Colorful Collective. These terms apply to all participants and to all activities and products offered by The Colorful Collective.

2.2. Deviations from these General Terms and Conditions are only possible if confirmed in writing by The Colorful Collective.

2.3. This agreement is governed by Dutch law.

2.4. Disputes arising from this agreement that cannot be resolved through mutual consultation will be submitted to the competent court in the region.

Article 3 Liability and Participation in Activities
3.1. Participation in an activity is entirely at the participant's own risk. The Colorful Collective, its employees, and instructors are not liable for personal injury or damage to the participant's property arising from participation in an activity. The Colorful Collective is also not liable for any damage caused by other services or advice provided by its employees or instructors.

3.2. Participants must assess for themselves whether they are suitable to participate in an activity. Participants must inform the instructor in advance of any physical and/or psychological complaints such as injuries, physical limitations, health issues, or pregnancy. In case of doubt regarding participation due to health issues, it is advised to consult the instructor and, if necessary, a physician.

3.3. The participant declares to participate in the activities of The Colorful Collective entirely at their own risk and responsibility. Participants must inform the instructor of any changes in their physical condition during the course of the lessons or activities.

3.4. Advice is always non-binding and followed at the participant's own risk.

3.5. The instructors of The Colorful Collective reserve the right to exclude participants deemed unsuitable from group activities to ensure participant safety.

3.6. The Colorful Collective is not insured for participant damage. The participant, contract partner, or counterpart declares that they are insured for damages resulting from participation in an activity.

3.7. The Colorful Collective is not liable for damage to and/or loss of personal belongings, whatever the cause, during or in connection with an activity.

3.8. The participant hereby unconditionally and irrevocably waives their right to compensation for any direct or indirect damage (whether from an agreement or wrongful act) arising in connection with participation in an activity.

3.9. The Colorful Collective reserves the right to cancel an activity due to insufficient interest/attendance. Activities may also be canceled in case of dangerous weather conditions, including thunderstorms, storms, extreme heat, snow, or ice.

Article 4 Membership
4.1. Participants are aware that their membership is for the agreed contract duration, starting from the ‘Start date subscription’ or ‘Purchase date credit card’ as stated in YogiBit.

4.2. Membership is strictly personal and can only be transferred to a third party with the consent of The Colorful Collective, which may charge administrative fees.

4.3. The Colorful Collective reserves the right to request identification from new members upon registration.

4.4. Members can register or cancel their participation in an activity up to 2 hours before the activity begins. The set times for each activity can be found in the YogiBit app. Failure to cancel on time will result in the activity being charged or deducted from the credit card.

Article 5 Registration and Participation in Classes
5.1. Participants must register in YogiBit. Members can sign up for classes up to 6 hours before the class starts. Exceptions are:

• Glow and Grow Fitness on Monday morning, where registration must be made 12 hours in advance;
• Postnatal Yoga (EN) on Wednesday evening, registration must be made 24 hours in advance;
• Prenatal Yoga (EN) on Friday morning, registration must be made 24 hours in advance.
  5.2. In case of inability to attend, participants must cancel at least 2 hours before the scheduled activity start time in YogiBit. Failure to cancel on time will result in a credit being charged.

Article 6 Co-working
6.1. Participants must register in YogiBit for the desired time slot. The maximum number of participants per flex slot is 4.

Article 7 Changes and Interim Modifications
7.1. The Colorful Collective is entitled to amend the terms and conditions applicable to membership. The Colorful Collective will notify participants of changes in a timely manner. Changes will take effect one calendar month after the announcement unless a different statutory period is required, in which case that will apply. If a participant does not accept a change that negatively affects them, they may terminate their membership effective the date the new terms come into force. Written termination must be received by The Colorful Collective before the effective date of the change.

7.2. The Colorful Collective may make interim changes to the facilities, class schedules, programs, and opening hours. The Colorful Collective reserves the right to change the group lesson schedule at any time for its own motivational reasons. The payment obligation remains in effect in these cases.

Article 8 Force Majeure, Illness, Holidays, and Public Holidays
8.1 The Colorful Collective is not obligated to fulfill any obligations under the agreement if it is prevented from doing so due to a circumstance that is not attributable to The Colorful Collective under the law, legal action, or generally accepted principles.

8.2 In these general terms and conditions, force majeure includes, in addition to what is understood by law and jurisprudence, the following: (civil) war and threat of (civil) war, natural disasters, strikes, excessive absenteeism or illness of staff or third parties engaged by The Colorful Collective, epidemics, pandemics, fire, flooding, power outages, government measures, failure by suppliers or third parties engaged by The Colorful Collective, and all causes beyond the control of The Colorful Collective that make it impossible for The Colorful Collective to fulfill its obligations under the agreement.

8.3 In case of force majeure, The Colorful Collective will make every effort to fulfill the agreement in an alternative way. The participant will follow all instructions from The Colorful Collective.

8.4 If the force majeure situation lasts longer than two (2) months, both The Colorful Collective and the participant are entitled to terminate the agreement, with due regard for the notice period mentioned in Article 3.7.

8.5 In case of illness and/or vacation of one or more instructors, the schedule of activities may be adjusted. It is possible that events may be canceled or combined. This is factored into the applicable rate, and no refunds or other compensation can be claimed. The Colorful Collective will always attempt to arrange a replacement instructor, but if this is not possible, the activity will be canceled.

8.6 On the following generally recognized public holidays, activities will not take place unless otherwise communicated. The payment obligation remains in effect in these cases as this is factored into the applicable rate.
• New Year's Day
• Good Friday
• Easter Sunday and Monday
• King's Day
• Ascension Day
• Liberation Day (lustrum years)
• Pentecost Sunday and Monday
• Christmas Eve
• Christmas Day and Boxing Day
• New Year's Eve

Article 9 Cooling-off Period
9.1 The participant, who is a natural person and not acting in the exercise of a profession or business, has the right to terminate the agreement free of charge within a cooling-off period of fourteen (14) calendar days. This cooling-off period starts the day after the agreement is concluded.

9.2 If the participant uses The Colorful Collective's services at their own request during this cooling-off period and then invokes their right of withdrawal, the participant will owe The Colorful Collective a proportionate fee for the period during which they used the services.

9.3 The participant can notify The Colorful Collective of the exercise of their right of withdrawal by submitting a written request.

Article 10 Duration and Termination
10.1 The Colorful Collective is entitled to terminate the agreement in whole or in part immediately without any obligation to pay compensation if the participant does not, or only partially, fulfill their obligations under the agreement.

10.2 Termination of the membership by the participant must be done in writing via the website of The Colorful Collective. A notice period of one calendar month applies, with the month of termination not being counted. The agreement has a minimum duration of six months.

Article 11 Fees, Price Changes, and Payment
11.1 The Colorful Collective will automatically debit the membership fee every month. The participant must timely provide the direct debit authorization form to The Colorful Collective or sign it digitally in the app. If, for any reason, automatic debit is not possible, The Colorful Collective is entitled to deny the participant access to the activity until the participant has fulfilled their financial obligations. In that case, the duration of the agreement will not be extended by the duration of the suspension.

11.2 The subscription fee is agreed upon before the conclusion of the agreement.

11.3 The Colorful Collective reserves the right to unilaterally increase prices. The current prices are always the applicable prices and are always available on The Colorful Collective's website or in the YogiBit app.

11.4 In the event of a price increase, the participant has the right to terminate the agreement within 4 weeks after the price increase is announced.

11.5 A membership fee will be automatically debited from the participant's bank account each month, except for the first month, which is paid immediately upon registration.

11.6 Any agreement other than a membership must be paid for in advance in a single payment.

11.7 Unless otherwise agreed, payments must be made via automatic debit or through The Colorful Collective's webshop.

11.8 If the amount due cannot be debited from the bank account, a reminder will be sent. If no response is made and no payment follows, EUR 25 administration costs will be charged, which will be debited with the next monthly payment.

11.9 In compliance with applicable law, the participant is responsible for all costs incurred by The Colorful Collective or a third party engaged by The Colorful Collective for the collection of any amount owed to The Colorful Collective.

11.10 The Colorful Collective has the right to suspend its obligations if the participant fails to fulfill their obligations on time.

Article 12 Suspension (pausing/temporarily halting)
12.1 Only in the case of prolonged illness, injury, or pregnancy can the membership be temporarily suspended with written consent from The Colorful Collective (this does not apply for, e.g., studies, internships, work, or vacations). At the first request of The Colorful Collective, the participant must provide written proof.

12.2 Any suspension request must be submitted in writing, including a full explanation of the reason for the membership suspension.

12.3 A written request must always be submitted at least 14 days before the month in which the suspension will take place.

12.4 Suspension of the membership can never be applied retroactively.

12.5 The participant's payment obligation is suspended for the actual duration of the suspension. The end date of the membership agreement will be extended by the duration of the suspension. The first term may still be debited, and the amount will be settled upon reactivation of the membership. It is in no case a way to defer the payment obligation.

12.6 The Colorful Collective reserves the right to reject a request without stating a reason.

Article 13 Participant Obligations
13.1 The participant is familiar with the house rules used by The Colorful Collective. These house rules are available in all spaces. The participant is required to comply with these house rules.

13.2 The Colorful Collective may, at any time, refuse or deny access to individuals whose behavior justifies this.

13.3 Participants must report any medical contraindications, if applicable, to The Colorful Collective before the start of the activity.

13.4 Participants must follow the instructions of The Colorful Collective and/or its appointed staff.
13.5 Participants must promptly notify The Colorful Collective of changes in postal address, email address, bank account number, and telephone number.

Article 14 Interim Changes
14.1 The Colorful Collective may make interim changes to the facilities, class schedules, programs, and opening hours.

14.2 The Colorful Collective will announce the intended changes at least two (2) weeks in advance unless such changes cannot reasonably be announced that far in advance.

14.3 In the case of changes as referred to in Article 3 that are detrimental to the participant, the participant has the right to terminate the membership with one month's notice within four (4) weeks of the announcement unless the change does not justify termination.

Article 15 Personal Data
15.1 The Colorful Collective processes participants' personal data in accordance with the applicable laws and regulations regarding the protection of privacy, particularly the Personal Data Protection Act, in a manner and for the purposes described below.

15.2 The Colorful Collective processes personal data for the following purposes: billing, debtor administration, handling complaints and disputes, preventing, detecting, and combating fraud and irregularities, market research, and commercial purposes such as sales activities related to The Colorful Collective's services and/or services of third parties related to The Colorful Collective's services.

15.3 Participants have the right to access, correct, and object to the processing of their personal data. The Colorful Collective may charge a fee up to the legal maximum for access and/or corrections or handling objections. The relevant participant may object to the processing of their personal data and request access, correction, or objection by sending a written request to The Colorful Collective.

15.4 Participants give permission for the creation and publication of image material at The Colorful Collective in which they are recognizable. If a participant does not wish this, they can indicate this to the management of The Colorful Collective, and The Colorful Collective will honor this request.

15.5 YogiBit is offered by the online service SportBit Manager. The privacy statement regarding the use of YogiBit can be read at https://www.sportbitmanager.nl/privacy/.

Article 16 Complaints and Disputes
16.1. Participants must report any complaints regarding any performance of The Colorful Collective as soon as possible after the defect or damage has been discovered, and no later than fourteen (14) days after the participant has discovered the defect or damage. The complaint must be submitted in writing to The Colorful Collective, specifying the description of the complaint.

16.2. The complaint must be complete, clearly described, and accompanied by any evidence.

16.3. The Colorful Collective will respond to the participant's complaint as soon as possible, but no later than four (4) weeks from the date of receipt. If The Colorful Collective expects to take longer to process the complaint, they will notify the participant immediately by email.
16.4. If the complaint cannot be resolved through mutual consultation, a dispute arises in accordance with Article 2.4 of these Terms and Conditions.
